Oregon — Oregon Attorney General Dan Rayfield joined a coalition of states in filing a federal lawsuit challenging recent changes to the nation’s childhood immunization schedule implemented by the Trump administration.
The complaint names U.S. Department of Health and Human Services Secretary Robert F. Kennedy Jr., Acting Centers for Disease Control and Prevention Director Jay Bhattacharya, and the CDC and HHS as defendants. The states allege federal officials bypassed established legal procedures and scientific review when altering long-standing vaccine recommendations.
At issue is a January 5, 2026 CDC decision that removed seven vaccines—those protecting against rotavirus, meningococcal disease, hepatitis A, hepatitis B, influenza, COVID-19, and respiratory syncytial virus (RSV)—from the list of universally recommended childhood immunizations.
Rayfield said the changes risk undermining public confidence in vaccines and public health protections.
“In Oregon, we’re already seeing the consequences of the federal government’s reckless actions and vaccine narrative,” Rayfield said, citing a recent measles outbreak in the state that officials say is largely linked to unvaccinated individuals.
The lawsuit also challenges the restructuring of the CDC’s Advisory Committee on Immunization Practices (ACIP), the federal expert panel that has historically guided U.S. vaccine policy. According to the complaint, Health and Human Services Secretary Kennedy dismissed all 17 ACIP voting members in June 2025 and replaced them with new members, some of whom the states argue lack the scientific qualifications required under federal law.
Federal health officials say the revised schedule reflects a scientific review and comparison with immunization policies in other developed countries. According to a CDC fact sheet, the updated schedule continues to recommend vaccines for 10 diseases for all children—including diphtheria, tetanus, pertussis, Haemophilus influenzae type b (Hib), pneumococcal disease, polio, measles, mumps, rubella, and human papillomavirus (HPV)—as well as varicella, or chickenpox.
Other vaccines, including those for RSV, hepatitis A, hepatitis B, dengue, and meningococcal disease, are now recommended primarily for high-risk groups or populations. Vaccines for rotavirus, COVID-19, influenza, meningococcal disease, hepatitis A, and hepatitis B may also be administered based on shared decision-making between physicians and parents.
The CDC says the revised policy is intended to align more closely with practices in peer nations while maintaining access to all previously available vaccines. Federal officials also stated that vaccines removed from the universal schedule will remain covered by insurance under the Affordable Care Act, Medicaid, the Children’s Health Insurance Program, and the Vaccines for Children program.
Health officials say the agency will continue monitoring vaccine uptake, infectious disease rates, and safety data as the updated schedule is implemented.
In addition to Oregon, attorneys general from Arizona, California, Colorado, Connecticut, Delaware, Maine, Maryland, Michigan, Minnesota, New Jersey, New Mexico, Rhode Island, and Wisconsin joined the lawsuit, along with the governor of Pennsylvania.
The coalition is asking the court to declare the revised immunization schedule and ACIP appointments unlawful and to restore the previous recommendations while the case proceeds.
