Lincoln County Man Sentenced to Life in Prison for Sexual Abuse of Family Member

A 61-year-old Lincoln County man was sentenced to life in prison without the possibility of parole after being convicted of sexually abusing a 16-year-old family member.

Lincoln County Circuit Court Judge Amanda Benjamin sentenced Herman Walter Graham on September 22, 2026, following a three-day jury trial. Graham was found guilty of four counts of Sexual Abuse in the Third Degree and one count of Sexual Abuse in the Second Degree.

Prosecutors said Graham had nine prior felony convictions for Sexual Abuse in the First Degree stemming from the repeated sexual abuse of two children in his immediate family. Those convictions occurred in 1997 and 2001.

Under Oregon law, defendants who have two prior qualifying sex-crime convictions can face a presumptive sentence of life imprisonment without the possibility of release or parole for a subsequent qualifying offense, unless the sentencing judge finds substantial and compelling reasons to impose a lesser sentence.

During sentencing, Graham asked the court for a lighter sentence, arguing that a life sentence was unduly harsh. Judge Benjamin instead imposed life imprisonment without the possibility of parole.

Addressing the victim, Benjamin said, “Your voice was heard and it was believed clearly through the verdicts of the jury. Your voice prevented further victims and more abuse from happening.”

The case was prosecuted by District Attorney Jenna Wallace and investigated by the Benton County Sheriff’s Office and the Lincoln County Sheriff’s Office.
