Washington, D.C. — The U.S. Department of War announced today that it has opened a formal review into allegations of misconduct involving now Senator and formerly Captain Mark Kelly, USN (Ret.). According to the agency’s statement, the review will determine whether further action is warranted, including the possibility of recalling Kelly to active duty for court-martial proceedings or imposing administrative measures.
Officials emphasized that the process will follow the Uniform Code of Military Justice and related federal statutes. The department noted that military retirees remain subject to the UCMJ and cited federal law prohibiting efforts to undermine military loyalty, morale, or good order and discipline.
The statement also reiterated that servicemembers are legally obligated to follow lawful orders and that personal views do not exempt individuals from compliance. The department said it will limit further comment to preserve the integrity of the review.
The statement follows Senator Kelly joining other Democrats in a video telling active duty military members they can refuse illegal orders. The video has drawn a substantial amount of controversy and pushback. The Vice President challenged this video in a post on X stating “If the president hasn’t issued illegal orders, them members of Congress telling the military to defy the president is by definition illegal.”
In an interview on ABC Senator Slotkin was asked directly if she believed President Trump had issued illegal orders. She stated “To my knowledge I am not aware of things that are illegal, but certainly there are some legal gymnastics going on with these Caribbean strikes.”
The competing statements have intensified a fast-moving national dispute over civil–military boundaries as the Department of War conducts its review. Following the recent record length government shutdown the situation further underscores the high political stakes in the deep partisan conflict as Democrats seek opportunities to challenge the Trump administration.
