AN ORDINANCE RELATING TO REPEALING THE SAFE SALEM EMPLOYEE PAYROLL TAX; REPEALING ORDINANCE NO. 12-23 CONTAINING SRC 39.001, 39.005, 39.010, 39.015, 39.020, 39.025, 39.030, 39.035, 39.040, 39.990; AND DECLARING AN EMERGENCY.
The City of Salem ordains as follows:
Section 1. Ordinance No. 12-23, containing SRC 39.001, 39.005, 39.010, 39.015, 39.020, 39.025, 39.030, 39.035, 39.040, and 39.990 is hereby repealed.
Section 2. Findings. Ordinance No. 12-23 was passed by the City Council on July 10, 2023. On August 14, 2023, the Marion County Elections Official certified Referendum Petition No. R-EPT-2023-1 exceeded the minimum number of valid signatures to qualify for the ballot and declared that the referendum measure will be part of the November 7, 2023 Special Election. The City of Salem is required under state law to submit a Notice of Measure Election to the Marion County Elections Official prior to September 7, 2023.
Section 3. Codification. In preparing this ordinance for publication and distribution, the City Recorder shall not alter the sense, meaning, effect or substance of this ordinance, but within such limitations, may:
(a) Renumber sections and parts of sections of the ordinance;
(b) Rearrange sections;
(c) Change reference numbers to agree with renumbered chapters, sections or other parts;
(d) Delete references to repealed sections;
(e) Substitute the proper subsection, section or chapter, or other division numbers;
(f) Change capitalization and spelling for the purpose of uniformity;
(g) Add headings for purposes of grouping like sections together for ease of reference; and
(h) Correct manifest clerical, grammatical or typographical errors.
Section 4. Severability. Each section of this ordinance, and any part thereof, is severable, and if any part of this ordinance is held invalid by a court of competent jurisdiction, the remainder of this ordinance shall remain in full force and effect.
Section 5. Emergency Clause. This act being necessary for the immediate preservation of the public peace, health and safety, an emergency is declared to exist, and this ordinance shall be in full force and effect from and after the date of its passage.
